Yes, There Is A Generation Gap

Years ago, I was representing a young attorney in a civil action who was being deposed.  Throughout the questioning, he kept glancing down toward his crotch.  For the record, there was nothing otherwise remarkable about his crotch.  What he was doing was looking at his Crackberry every few seconds.  I’ve got no idea what he was anticipating, if anything, that was so compelling that he would risk blowing the deposition, but his responses to questions were, to be kind, less than adequate.

I told the other lawyer that I needed a five minute break, and pulled my client toward the door with me.  Without a word, I continued to drag him until we came to the men’s room.  We entered, after which I grabbed the Crackberry from his hand and threw it down against the tiles.

I cannot begin to put into the words the sense of satisfaction I felt as it shattered.

Yes, there is a generation gap.  I admit it.  Mea culpa.

    Heh. I used to have a college professor who would do this. No, not smash student phones. He’d answer his own phone in the middle of class. Not only was the whole class waiting for him to finish, but the class was broadcast to other sites and videotaped for future use. Granted, he kept the calls short, but I never saw him ignore the phone or send it to voicemail.

    What’s the law school hypo answer to Mr. Greenfield’s actions? A civil action for conversion, maybe even battery for the contact involved in grabbing the Blackberry? I don’t know, but I bet the young attorney wasn’t stupid enough to pursue it.

    What’s the reasonable reaction to the young attorney’s conduct? A stiff backhand to the young attorney’s head–that’s where the problem is, not the Blackberry.

    It’s not just a generation gap, it’s a gulf. Neither side has the resources to bridge it.

    I neglected to mention that we had discussed these options in advance of the deposition. I had earlier surmised that he was not a serial masturbator, but a crackberry addict.
