Unplanned Parenthood: Law Triumphs Over Politics

At Fault Lines, Murray Newman has written the definitive post on how Harris County District Attorney Devon Anderson, a staunch conservative Republican, put law ahead of party politics.  While everyone else is screaming about their hatred, Murray tells a story of prosecutorial integrity.

No matter how you feel about Planned Parenthood or abortion, this is what you must know.

“As to the lack of political motive behind the indictment, you bet your ass.”
But that’s really all the article puts out there. I was ready for details/analyses of the actual laws themselves, how often this happens in the grand jury process, etc. Most people don’t need lawyers to explain non-lawyerly things to us….

That was an enormous, and horribly controversial, issue when the indictment was announced (edit: and is still raging today, where misinformation and speculation is driving people (just say a quote from Rubio) to make ridiculously and dangerously wrong claims). You wanted something else? Well, since it’s all about you. What most people need is to understand the huge issues before them about which they engage in wild and baseless speculation without having the benefit of someone who knows what happened on the inside. So this didn’t please you? Bummer.

So, a CDL from Texas says this hammer doesn’t think everything is a nail. And he can do so based on his assessment of said hammer’s ideology. I guess it’s settled.

A more accurate characterization would be that a long time former-prosecutor who maintains close ties with the Harris County DA, and who is personally politically on the other side, and knows the Harris County DA to also be politically on the other side (and who we believe because we know him well, and know him to be a person of exceptional integrity), says that if the DA was to follow her politics, the indictment would have gone the other way. But that it didn’t, in opposition to her political views, reflects that politics was put aside and the indictment reflects the evidence, even though it runs directly against the DA’s and writer’s personal politics.

And so, it’s settled. You’re welcome.

The investigation of Planned Parenthood is ongoing by both the Harris County DA and the Texas AG Office. It is very likely that this indictment has been brought forward to give the appearance of fairness The DA and the AG will spend the next several years making Planned Parenthood of Texas completely miserable without ever bringing an indictment. Planned Parenthood will never get as far as beating the rap because the ride won’t be allowed to end.

Basis for this conspiracy theory? If you want to make a wild, baseless claim, then you have to give up who you are, what you know and how you reach it. If you want to stay anon, then it’s just the typical worthless crap nutjobs spew. Which is it?

Speaking of conspiracy theories, it could have been a member or two of this grand jury who asked the right questions and then convinced their peers to instruct the DA to we’ll you know follow the yellow brick evidence road.

P.S. Stop picking on Jardinero it’s primary season, which is reason enough, for many seeking office in Texas, to keep a “good” ride going. There is also this retort from the ‘Gov-nar:

♡♡♡Despite the grand jury’s indictments, Republican Gov. Greg Abbott said the state would move forward with its investigations of Planned Parenthood, including inquiries by the Texas Health and Human Services Commission and Texas Attorney General Ken Paxton.

“Nothing about today’s announcement in Harris County impacts the state’s ongoing investigation,” Abbott said in statement. “The State of Texas will continue to protect life, and I will continue to support legislation prohibiting the sale or transfer of fetal tissue.”♧♧♧

        Whee…

I do not propose that there is a conspiracy. I state only facts. The investigation is ongoing at the county and state level. The indictment does give the appearance of fairness. And it is a fact that Planned Parenthood of Texas will spend a great deal of PR and legal resources, for the next year or two, fending off the continued investigation of its operation by the State of Texas and the Harris County DA’s Office.

I don’t normally do this, but that was an especially useful and informative post you linked to, and I’m glad that you decided to give it wider exposure. I tend to be suspicious of charges brought in the middle political football matches like this one, regardless of which “side” they seem to benefit, and really appreciate the context you and Mr Newman have provided.
