Passive Physical Resistance Gets A Jolt

Ah, it’s the merry holiday, good will toward man and all that stuff. Which means, it’s time for another taser video.

This time, the woman was tased at Best Buy because, according to the police chief, she was “loud and profane” at one point, or engaged in “passive physical resistance” at another.  I engage in passive physical resistance all the time.  You just can’t tell because I’m doing nothing.  Fortunately, I prefer to do it in the privacy of my own home, where the only people who feel compelled to act against me are my children, and I’ve been wise enough to deny them access to tasers. 

So here it is.  Happy holidays.  And remember, you really can get anything electronic at Best Buy!

    Thanks for putting the word out on this. Things like this don’t typically surprise criminal defense lawyers, as we have a unique perspective, on the way the police power tends to corrupt. But, thanks to youtube the phrase “Don’t taze me bro” was the phrase of the year and the public gets to see what we’ve been trying to tell them: don’t surrender your rights in the name of fighting crime or terrorism as the rights of the best people are safe only so long as those of the most abhorrent are protected.

    Notice how the chief says “she continued to be irate and the officer said ‘you’re causing a disturbance” right before the tazer went off. In fact, it looked like she was walking away, towards the door.

    So the public is getting a look at the need for tazer reform. Hopefully “tort reform” hasn’t been implemented in this state and the woman can teach the police that if you shoot first and ask questions later, you have to pay for the damages you caused.

    My fear is that the lesson people might get is that you better be nice when returning those holiday gifts or the store security guard might just take you down for being “irate.”
