The way it works, senators recommend people to the executive for appointment as judges within their states. In New York, the senior senator gets 3 to the junior senator’s 1. Our junior senator, of course, is the vivacious Hillary Clinton, the quintessential New Yorker now running against Rudy Guiliani, some rube from wherever people marry their second cousin. Oops. Well, they will be running against each other soon, anyway.
What is most important about New York’s senators is that they are both Democrats. This means that they will scour the countryside looking for judicial appointee candidates that reflect the finest of Democratic traditions.
So why are all the people selected either Biglaw or prosecutors? Hey Chuck, there are other people out here too.
Today, I note that Charles (that’s what Chuck’s called in the media) Schumer announced the nomination of Cathy Seibel, deputy to Southern District U.S. Attorney Michael Garcia, for a judgeship in the Southern District of New York. Now I don’t know Cathy Seibel, and I’m sure she’s eminently qualified, but she’s a prosecutor. Chuck, you’re a Democrat. Would it kill you, Chuck, to think outside the box?
Sure, I can appreciate that President Bush isn’t going to take well to anybody whose view of criminal justice is shy of Attila the Hun. After all, what are the chances he’s going to appoint some activist, liberal, pinko commie judge, right? But why do you have enable this?
Thinking back, when George W. Bush was governor, we still didn’t have anyone who wasn’t a prosecutor or Biglaw nominated for the New York City federal bench. How do you explain that one, Mr. Democratic Senator?
Lots of talk about the constitution when you’re shooting at the other side, but when you have the ability to do something about it, you’re picking judges off the same list that Alfonse D’Amato was using when he was in your shoes. Of course, even Al was more concerned about getting a fair criminal trial in New York, if only for selfish family reasons.
Come on, Senator Schumer. Be a Democrat already. There is a whole world of lawyers who aren’t Biglaw or prosecutors who would bring ideals to the bench that you are supposed to support. Give them a try.
