Lieberman to Internet: You’re Fungus (Update)

While it would be in everyone’s best interest to keep their house clean, the protection of Section 230 of the Communications Decency Act is without question the single most important factor that allows the flow of communication on the internet.  This, apparently, is killing Connecticut’s paragon of virtue, partyless Senator Joe Lieberman.

The word just out is that Lieberman is sponsoring a bill to amend Section 230. Well, amend is too kind a word. Emasculate strikes closer to home.  The  McIntyre v. Ohio.

Regardless of how you feel about bullying, Happysphere, or any other variation of partially censorious speech, we will all fall together if Section 230 imposes liability on website owners for the comments of others. Don’t let this happen.

    To comply with this law and to retain any defense against liability, a blog would have to police its comments or, more easily, shut them down completely. It would mean that I’d have to close my blog if I were to go on vacation in such a manner that I could not constantly monitor comment activity.

    If I were suddenly hospitalized, I’d have to add the worry of finding someone else to do the monitoring or, at the least, someone to shut it down.

    I’d face the same impossibilities were I to travel to a country that blocked access to my blog. Were I to end up behind bars, the same impossibilities threaten.

    Lieberman’s amendment — assuming he’s not giving us an April Fool’s Day joke — would shut down all commenting on the Internet. Perhaps that is his goal. I’d rather think it an unintended consequence of fungus-fighting.

    Leiberman is also an information content provider as are all members of congress and the executive branch.

    Given Lieberman’s past history of trying to censor all sorts of music, movies, and videogames that he doesn’t like, I say his attempt to censor the internet is a feature and not a bug.
